These Terms and Conditions (the "Terms") govern your access to and use of warrobe.app and the related services provided by Warrobe (together, the "Services"). By accessing or using the Services, creating an account or publishing content, you agree to these Terms.
If you do not agree to these Terms, do not use the Services.
1. About Warrobe
The Services are operated by Warrobe. You can reach us at hello@warrobe.app.
Warrobe is a fashion-discovery platform where creators may publish wardrobes, product selections and related content, and users may discover products offered by third-party merchants.
2. Eligibility
You must be at least 16 years old to use the Services. If the law where you live requires you to be older to enter into a binding contract, you must meet that minimum age.
By using the Services, you confirm that you are legally capable of agreeing to these Terms and that the information you provide is accurate and complete.
3. Accounts
Some features require an account. You agree to:
- provide accurate and current information;
- keep your login details confidential;
- promptly update information that changes;
- notify us at hello@warrobe.app if you suspect unauthorised access; and
- accept responsibility for activity carried out through your account, except where caused by Warrobe's failure to use reasonable security measures.
You may not impersonate another person, create an account using information you are not authorised to use, sell or transfer your account, or use automated methods to create accounts.
4. The Warrobe service
Warrobe helps users discover fashion products and creator recommendations. Unless expressly stated otherwise:
- Warrobe does not manufacture, own, stock or sell the products displayed on the Services;
- product purchases are made directly from independent third-party merchants;
- the purchase contract is between you and the relevant merchant, not Warrobe;
- the merchant controls product descriptions, prices, availability, delivery, returns, refunds, warranties and customer support; and
- Warrobe is not responsible for a merchant's products, website, conduct or fulfilment of an order.
You should review the merchant's terms, privacy policy, delivery information and returns policy before purchasing.
5. Product information and availability
We aim to present product information accurately, but information supplied by creators, merchants, affiliate networks or other third parties may be incomplete, delayed or inaccurate. Prices, availability, colours, sizing and other product details may change without notice.
Images are illustrative and may not precisely represent a product. Where information on Warrobe differs from the merchant's website, the information shown by the merchant at checkout applies.
6. Affiliate links and commercial relationships
Some links on Warrobe are affiliate links. If you click a link or make a purchase, Warrobe and/or the featured creator may receive a commission from the merchant or affiliate network, at no additional cost to you unless clearly stated otherwise.
Creators must clearly disclose paid, gifted, sponsored or affiliate relationships where required by law and must not make misleading claims about products or commercial relationships.
The presence of a product or merchant does not constitute a guarantee, warranty or endorsement by Warrobe.
7. Creator accounts
If you use the Services as a creator, you agree that:
- your profile, wardrobe selections and published content may be publicly visible;
- you will only publish content and product claims that are accurate and lawful;
- you will comply with advertising, endorsement, consumer-protection and intellectual-property laws;
- you will disclose commercial relationships clearly and prominently;
- you will provide any information reasonably required to verify your identity, eligibility, tax status or payment details; and
- you will not manipulate clicks, transactions, engagement, attribution or commission records.
Additional creator, campaign or commission terms presented to you in writing form part of these Terms. If those additional terms conflict with these Terms, the additional terms apply to the relevant creator service or campaign.
8. Commissions and payouts
Where Warrobe offers creator commissions:
- commissions are calculated using information received from merchants or affiliate networks;
- a transaction may be excluded or reversed if it is cancelled, returned, refunded, fraudulent, self-referred, improperly attributed or otherwise ineligible;
- tracking technologies may fail or be blocked, and not every click or transaction can be attributed;
- payout timing, thresholds, currencies, fees and eligibility will be shown in the creator dashboard or applicable programme terms;
- creators are responsible for providing correct payout and tax information and for declaring and paying taxes applicable to their earnings; and
- Warrobe may withhold or delay payment where reasonably necessary to investigate fraud, legal compliance, chargebacks or attribution disputes.
Except in the case of an obvious error, Warrobe's records and the records supplied by the relevant merchant or affiliate network will be used to determine commission eligibility.
9. User content
"User Content" means photographs, images, text, captions, links, profile information, wardrobe selections, comments and other material you submit or publish through the Services.
You retain ownership of your User Content. By submitting User Content, you grant Warrobe a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to host, store, reproduce, adapt for technical or formatting purposes, display, distribute and communicate that content for the purpose of operating, improving and promoting the Services. This licence ends when the content is deleted from our systems, except where continued retention is legally required or the content has already been lawfully used in materials that cannot reasonably be withdrawn.
You confirm that:
- you own your User Content or have all permissions needed to use it;
- your User Content does not infringe intellectual-property, privacy, publicity or other rights;
- people identifiable in your User Content have provided any necessary permission;
- your User Content is accurate where it makes factual or commercial claims; and
- your User Content complies with these Terms and applicable law.
10. Prohibited conduct and content
You may not use the Services to:
- publish illegal, fraudulent, defamatory, threatening, hateful, discriminatory, sexually exploitative or seriously harmful content;
- infringe intellectual-property, privacy, publicity or other rights;
- mislead users about products, prices, sponsorships, endorsements or your identity;
- distribute malware, scrape the Services without permission, interfere with security or attempt unauthorised access;
- send spam or conduct unauthorised advertising;
- buy, sell or manipulate engagement, clicks, referrals or commissions;
- use the Services to develop or train an automated system without our written permission;
- collect personal data about others unlawfully; or
- encourage another person to do any of the above.
11. Content moderation and enforcement
We may review, restrict visibility of, demonetise, remove or disable access to content or accounts where we reasonably believe they violate these Terms, applicable law, the rights of others or the security and integrity of the Services.
Depending on the nature and seriousness of the issue, we may issue a warning, limit features, suspend payouts, suspend an account or permanently terminate access. We may use automated systems and human review to detect or assess violations. We will act proportionately and provide reasons or an opportunity to challenge a decision where required by applicable law.
To report illegal or infringing content, contact hello@warrobe.app and provide enough information for us to identify and assess the material.
12. Intellectual property
The Services, excluding User Content and third-party material, including the Warrobe name, branding, design, software, databases, text and graphics, are owned by or licensed to Warrobe and are protected by intellectual-property laws.
We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Services for their intended purpose in accordance with these Terms. No other rights are granted.
You may not copy, modify, distribute, sell, license, reverse engineer or commercially exploit any part of the Services unless permitted by law or authorised by us in writing.
13. Copyright and other rights complaints
If you believe content on Warrobe infringes your rights, email hello@warrobe.app with:
- your name and contact information;
- identification of the protected work or right;
- the location of the disputed content;
- an explanation of the alleged infringement;
- a statement that the information provided is accurate; and
- evidence that you own the right or are authorised to act for the owner.
We may request further information and may share your notice with the person who posted the content where legally permitted.
14. Paid Warrobe services
If Warrobe offers subscriptions or other paid Services, the applicable price, billing frequency, included features, renewal terms and cancellation method will be disclosed before purchase. You authorise us and our payment provider to charge the payment method you select.
Unless otherwise stated, subscriptions renew automatically for the period shown at checkout until cancelled. Cancellation takes effect at the end of the current billing period, and you retain access until then.
Nothing in these Terms limits mandatory consumer rights. Where EU or UK consumer law applies, you may have a 14-day right to withdraw from a distance contract. If you ask us to begin supplying a paid digital service during that period, you may be required to expressly consent and acknowledge the consequences for your withdrawal right.
15. Privacy and cookies
Our Privacy Policy explains how we process personal data. Our Cookie Policy explains how we use cookies and similar technologies. Both policies form part of your use of the Services.
16. Third-party services
The Services may contain links to merchants, social platforms, payment providers and other third-party services. We do not control those services, and their own terms and privacy policies apply. Accessing third-party services is at your discretion.
17. Service availability and changes
We may update, modify, suspend or discontinue parts of the Services to improve functionality, maintain security, comply with law or respond to commercial or technical needs. We do not guarantee that the Services will always be uninterrupted, error-free or available in every location.
Where a change materially affects a paid Service or your rights, we will provide notice where required by law.
18. Account suspension and termination
You may stop using the Services at any time and may request account deletion by emailing hello@warrobe.app.
We may suspend or terminate access where you materially or repeatedly breach these Terms, create legal or security risk, engage in fraud or misuse, or where required by law. Where appropriate and legally required, we will provide notice and reasons.
Provisions that by their nature should survive termination — including those concerning intellectual property, commissions already subject to verification, liability, disputes and governing law — will continue to apply.
19. Disclaimers
Warrobe provides a discovery and publishing service. Creator opinions and recommendations are their own and do not necessarily reflect Warrobe's views. We do not guarantee that a recommendation will suit you or that any product will meet your expectations.
To the extent permitted by law, the Services are provided on an "as available" basis. We do not exclude warranties or rights that cannot lawfully be excluded.
20. Limitation of liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or mandatory consumer rights.
Subject to the above, Warrobe will not be liable for indirect or consequential loss, loss of profits, loss of business, loss of opportunity, loss of goodwill or loss of data arising from use of the Services.
If you use Warrobe for business purposes, Warrobe's total aggregate liability arising from the Services will not exceed the greater of: (a) the amount you paid Warrobe during the 12 months before the event giving rise to the claim; or (b) €100. This business-user limitation does not apply to consumers where prohibited by law.
21. Indemnity for business users and creators
If you use the Services as a business or creator, you agree to compensate Warrobe for reasonable losses, liabilities, damages and costs arising from your unlawful User Content, breach of these Terms, infringement of another person's rights, or violation of advertising and disclosure obligations, except to the extent caused by Warrobe.
This section does not apply to consumers acting wholly outside their trade, business, craft or profession.
22. Changes to these Terms
We may update these Terms to reflect changes to the Services, law, security requirements or our business. The updated Terms will be published with a new "Last updated" date.
If a change materially affects registered users, we will provide reasonable notice where required. Continuing to use the Services after the effective date constitutes acceptance of the updated Terms, except where the law requires express consent.
23. Governing law and disputes
These Terms are governed by the laws of France, without prejudice to mandatory protections available to consumers under the law of their country of residence. The courts of Paris, France will have jurisdiction, except that consumers may bring proceedings in any court available to them under mandatory consumer law.
Before starting formal proceedings, please contact hello@warrobe.app so we can try to resolve the issue.
24. General terms
If any provision of these Terms is found unlawful or unenforceable, the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver of our right to enforce it later.
You may not transfer your rights or obligations under these Terms without our written consent. We may transfer our rights and obligations as part of a reorganisation, sale or transfer of the Services, provided this does not reduce mandatory consumer protections.
These Terms, together with policies and additional terms expressly incorporated into them, form the agreement between you and Warrobe concerning the Services.
